Twelve people who oppose the new downtown Sacramento arena project are taking their case to the California Court of Appeals.
The group filed notice of its intentions in Sacramento Superior Court today.
Last week, the plaintiffs failed in their attempt to convince a judge to issue a preliminary injunction and halt the project.
The twelve people claim the City's environmental impact report for the arena fails to identify the project's effects. The suit also claims a new law in unconstitutional because it limits injunctions in environmental impact report lawsuits.
Last Friday, Sacramento Superior Court judge, Timothy Frawley ruled the law is constitutional and the plaintiffs failed to meet the requirements within the law for an injunction.
In a written statement, Sacramento City Attorney James Sanchez said in part, “The filing of the Notice does not impair the Entertainment and Sports Center construction schedule and we remain confident in our defense.”
The City and the Kings are scheduled to begin demolition work in the morning at the Downtown Plaza mall where the arena will be built.
