Suspended UC Davis Chancellor Linda Katehi's attorney has issued a response to the allegations made against her.

Katehi's attorney Melinda Guzman produced documents Friday that show Katehi broke only one rule as chancellor -- taking a position on the for-profit Devry University board. But, Guzman says President Janet Napolitano's office knew about Katehi's intention to join the board a month before it was official.

Guzman says her client broke no rules when she joined several other boards. Nor did her husband, son and daughter-in-law receive preferential treatment while employed by the school.

Guzman called Napolitano's actions "unprecedented" "uncalled for" and "unprofessional."

He says Napolitano "...disclosed to the world the personnel action by providing incomplete and inaccurate information which was intended to mislead both the media and members of the public."

Guzman says any delays in responding to public records act requests are the fault of Napolitano's office.

Katehi's attorney says the investigation of her client should be scrapped and started over in part because the firm hired to investigate, Orrick Harrington and Sutcliffe, can not be considered impartial. The firm has been hired before to represent Napolitano and the UC system.

"We will not hesitate to try to enforce her rights," says Guzman. "What happened on April 27 was damning to her, her family, and to the campus community. Someone needs to address it. I believe that properly lies with the Board of Regents."

Guzman filed a grievance with the University of California General Counsel.
