Almost five years ago, California put all executions on hold because of legal challenges to the way the state carried out the death penalty. Albert Greenwood Brown was set to be the first death row inmate to be executed in the state's newly built lethal injection chamber. Brown was convicted of raping and murdering a 15 year old girl three decades ago.
But Governor Schwarzenegger has granted a 45 hour delay on the execution. Jeff Macedo is with the Governor's office.
The governor granted the reprieve to allow him to exhaust all of his appeals under the law.
Brown has until this Thursday, September 30th to make his final appeal. His execution has been rescheduled for 9 p.m. on that day. Attorney General Jerry Brown issued a statement that no executions can take place after September because of a shortage of one of the drugs that makes up the state's three drug cocktail.

13 Now the execution is set to occur just three hours before the drugs that they will use to kill him are set to expire, and their own moratorium on new executions takes effect. This is just crazy. This needs to stop and this execution should be halted.
