One Californian who got a lot of publicity during last year’s nomination process was California Supreme Court Justice Carlos Moreno. But Choper says although Moreno is a smart and capable judge, he doesn’t think Mr. Obama will pick a Latino this time.
 
Choper: “My guess is that his star has fallen a little bit because the president got Justice Sotomayor confirmed. And she satisfied that demographic need, if you will.”
 
Choper says he also doesn’t expect any of Moreno’s colleagues on the state supreme court to be chosen, nor the judges on the 9th U.S. Circuit Court of Appeals based in San Francisco.
